Welcome to Card Republic.
The terms "we", "us" and "our" refer to Card Republic. Card Republic operates this website and online store, including all related information, content, features, tools, products and services offered through it (collectively, the "Services").
Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.
These Terms of Service, together with any policies referenced in them, set out the terms and conditions governing your access to and use of our Services and your purchases from Card Republic.
By accessing, browsing, interacting with or using our Services, or by placing an order with Card Republic, you agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree to these Terms, you should not access or use our Services.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, restricted or modified, including rights that may apply under the Australian Consumer Law.
1. Eligibility and Accounts
By using our Services, you represent that you are legally capable of entering into a binding agreement or that you are accessing the Services with the permission and supervision of a parent or legal guardian where required.
When using our Services or placing an order, you may be required to provide information including your:

2. Products and Product Information
We make reasonable efforts to accurately display and describe our products.
However, product appearance, colours and other visual characteristics may vary depending on factors including:

Product images may be illustrative and may not always depict the exact individual item you receive unless expressly stated.

Nothing in this section limits your rights where a product is materially different from its description or otherwise fails to meet an applicable consumer guarantee.
3. Trading Cards and Collectible Products
Card Republic sells trading cards, collectibles and related products. Due to the nature of these products, the following conditions apply.
Randomised Products
Products such as booster packs, booster boxes, tins, collection boxes, mystery products and other sealed trading-card products may contain randomised contents.
Unless expressly stated otherwise, Card Republic does not guarantee:

A particular card;

A particular character;
-
A particular rarity;
-
A specific pull rate;
-
A particular combination of cards;
-
A minimum secondary-market value; or
-
Any financial return from purchasing or opening a product.
Pull rates, rarity distributions and product contents are determined by the relevant manufacturer or publisher.
Not receiving a particular card, rarity or monetary value does not by itself mean that a product is defective.
Singles and Individual Cards
Where we sell an individual trading card or other collectible, we make reasonable efforts to accurately describe its identity and condition.
Unless a specific professional grading standard is expressly stated, assessments of an ungraded card's condition involve a degree of judgement. Minor variations may occur in characteristics such as:

Centring;

Corners;
-
Edges;
-
Surface condition;
-
Print quality; and
-
Manufacturing imperfections.
Where a specific defect or condition issue is disclosed before purchase, that disclosed characteristic does not by itself make the product defective.
Graded Cards
Third-party graded cards are graded and encapsulated by independent grading companies.
Unless expressly stated otherwise, Card Republic does not independently guarantee or warrant:

The accuracy of a third-party grade;

The grading company's assessment methodology;
-
Population reports;
-
Registry information; or
-
Future changes to a grading company's standards or policies.
This does not affect any rights you may have where an item supplied by Card Republic is not authentic, is materially different from its description or otherwise fails to meet an applicable consumer guarantee.
Market Value
Trading cards and collectibles may increase or decrease in market value.
Card Republic does not guarantee the future value, resale price, investment performance, collectibility or market liquidity of any product.
Any prices, market values, comparisons or historical sales information displayed through our Services are for general informational purposes only unless expressly stated otherwise.
4. Orders
When you place an order, you are making an offer to purchase the products in your order.
Receiving an automated order confirmation does not necessarily mean that we have finally accepted your order. An order may be subject to:

Quantity limits;

Pricing verification; and

Other reasonable order checks.
Your order is accepted when we confirm acceptance or dispatch the relevant products, subject to applicable law.

5. Order Refusal and Cancellation
Subject to applicable law, we may decline or cancel an order where reasonably necessary, including where:

A product is unavailable;

An inventory error has occurred;

There is an obvious pricing or product-listing error;

Payment cannot be authorised or verified;

We reasonably suspect fraud, unauthorised payment activity or unlawful conduct;

An order exceeds a stated or reasonable purchase limit;

An order appears to have been placed using automated purchasing methods prohibited by these Terms;

We are unable to deliver to the address supplied;

A manufacturer, distributor or supplier does not provide expected stock;

There is a genuine technical or operational error; or
-
Accepting or fulfilling the order would breach applicable law.
Where we cancel an order after payment has been taken, we will provide an appropriate refund of amounts paid for the cancelled products, except where another outcome is permitted or required by law.
We may also limit quantities available to a customer, household, account, payment method or delivery address where reasonably necessary to manage limited stock, prevent fraud, maintain fair availability or protect our legitimate business interests.
6. High-Demand and Limited-Release Products
Certain trading-card products may be released in limited quantities or experience unusually high demand.
For these products, we may:

Apply purchase limits;

Restrict purchases per customer, household, account, payment method or address;

Cancel duplicate or excessive orders;
-
Allocate available stock between customers;
-
Cancel quantities that exceed a stated limit; or
-
Introduce additional purchasing conditions disclosed at the time of sale.
Any such measures will be applied reasonably and subject to applicable law.
Circumventing a purchase limit through multiple accounts, identities, payment methods or addresses may result in affected orders being cancelled.
7. Pre-Orders
Products identified as pre-orders are products that are not yet available for immediate dispatch.
Any release date, arrival date or dispatch estimate provided for a pre-order is an estimate only and may change due to circumstances including:

Manufacturer delays;

Distributor delays;
-
Shipping delays;
-
Release-date changes;
-
Product allocation;
-
Supply shortages; or
-
Events outside our reasonable control.
We will not intentionally represent an estimated release date as guaranteed where it is not guaranteed.
Pre-order quantities may also be subject to supplier allocation. Where we are unable to fulfil all or part of a pre-order, we may cancel the affected quantity and provide an appropriate refund.

8. Prices, Currency and Payment
Unless otherwise stated, prices displayed on our Australian website are in Australian dollars.
Prices will include GST where applicable and required by law.
Shipping costs and any other applicable charges will be displayed before you complete your order, where reasonably practicable.
You agree to provide current, complete and accurate payment, billing and account information.
You represent that you are authorised to use the payment method supplied for your purchase.
Prices, promotions and discounts may change from time to time. Changes will not ordinarily affect orders already accepted, except where permitted by law or where there has been an obvious error.
Promotional offers may be subject to separate terms and conditions. Where specific promotional terms conflict with these general Terms, the specific promotional terms will apply to that promotion.
9. Pricing and Listing Errors
We make reasonable efforts to ensure that product descriptions, prices, availability and other information are accurate.
Occasionally, errors may occur.
Where a genuine and obvious pricing, product, inventory or listing error occurs, we may correct the error and, subject to applicable law, decline or cancel an affected order.
Where payment has already been taken for an order that we subsequently cancel because of such an error, we will provide an appropriate refund.
Nothing in this section permits us to engage in misleading or deceptive conduct or removes rights that cannot lawfully be excluded.
10. Shipping and Delivery
Delivery timeframes are estimates unless expressly stated otherwise.
Actual delivery times may be affected by matters including:

Public holidays;

Peak trading periods;

Customs processing;

Incorrect delivery information;

Remote delivery locations; and

Other circumstances outside our reasonable control.
You are responsible for providing a complete and accurate shipping address.
Where an order is returned to us because an incorrect or incomplete delivery address was supplied, or because the customer failed to collect or accept delivery, additional shipping charges may apply before the order is resent, except where otherwise required by law.
We are not responsible for delays to the extent that they arise from circumstances outside our reasonable control, but nothing in these Terms excludes any responsibility we have under applicable law.
11. Tracking and Delivery Confirmation
Where tracking is available, tracking information may be provided to you after dispatch.
Carrier tracking information is supplied by the relevant delivery provider and may occasionally be delayed or inaccurate.
Where tracking records an order as delivered but you cannot locate it, please first check:

12. Returns and Refunds
Returns, refunds and exchanges are governed by our Return and Refund Policy.
Card Republic offers a 14-day change-of-mind return period for eligible products, subject to the conditions and exclusions stated in that policy.
Certain products are not eligible for change-of-mind returns, including certain trading-card products such as, but not limited to:

Booster packs;

Individual cards or singles;

Graded cards; and
-
Other products identified in our Return and Refund Policy.
For eligible change-of-mind returns, return shipping is at the buyer's expense.
These change-of-mind conditions do not exclude, restrict or modify any rights or remedies available under the Australian Consumer Law or other applicable law.

13. Australian Consumer Law
Our goods may come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms, our Return and Refund Policy or any other Card Republic policy is intended to exclude, restrict or modify any right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified.
Where a product fails to meet an applicable consumer guarantee, your rights and available remedies will depend on the circumstances and applicable law.
Our voluntary 14-day change-of-mind return policy is separate from rights that may exist under the Australian Consumer Law.

Third-party product names, characters, artwork, trademarks, logos and other intellectual property displayed on our website remain the property of their respective owners.
The sale of third-party products by Card Republic does not imply ownership of the intellectual property associated with those products.
You may use our Services for personal and lawful purposes.
Unless authorised by us or permitted by law, you must not reproduce, modify, publish, distribute, commercially exploit or create derivative works from our original website content.
15. Third-Party Intellectual Property
Card Republic may sell authentic products associated with third-party publishers, manufacturers, brands and intellectual property owners.
References to third-party brands, games or intellectual property are used for legitimate purposes such as identifying, describing and selling relevant products.
Unless expressly stated otherwise, Card Republic is not affiliated with, endorsed by or sponsored by third-party intellectual property owners merely because their products or intellectual property appear on our website.
16. Optional Third-Party Tools and Services
Our Services may provide access to tools, applications, payment providers or features operated by third parties.
We do not necessarily control these third-party services.
Your use of a third-party service may also be governed by the third party's own terms and privacy policies.
To the extent permitted by law, Card Republic is not responsible for independent third-party services or for losses caused solely by acts or omissions of those third parties outside our reasonable control.
17. AI Chatbot and Automated Assistance
Card Republic may provide an artificial intelligence-powered chatbot, virtual assistant or other automated tool through our Services to assist with general questions about our products, orders, policies and Services.
The chatbot is an automated system and may generate responses using artificial intelligence. Responses are provided for general informational and assistance purposes only and may occasionally be incomplete, inaccurate, outdated, misleading or otherwise incorrect.
You should not rely solely on information provided by the chatbot when making a significant purchasing decision or where accuracy is particularly important.
Official product listings, prices displayed at checkout, order confirmations and Card Republic's published policies take precedence over inconsistent information generated by the chatbot, subject to applicable law.

19. Relationship With Shopify
Card Republic is powered by Shopify, which enables us to provide our online Services to you.
However, purchases made from our store are transactions between you and Card Republic.
Shopify provides technology and infrastructure supporting our store but is not the seller of products purchased directly from Card Republic.
Your use of Shopify-related services may also be subject to Shopify's own applicable terms and privacy practices.
20. Privacy
Personal information collected through our Services is handled in accordance with our Privacy Policy.
Because our store is hosted by Shopify, certain personal information may also be collected and processed by Shopify and other service providers involved in providing our Services.

29. Indemnity
To the extent permitted by law, you agree to be responsible for reasonable loss or damage suffered by Card Republic as a direct result of:

31. No Waiver
If we do not immediately exercise or enforce a right available under these Terms, that does not necessarily mean that we have waived that right.
A waiver of a particular right or breach does not constitute a waiver of any future right or breach unless expressly stated.

These Terms, together with policies and other terms expressly incorporated by reference, constitute the agreement governing your use of our Services.
Where specific product, promotion, pre-order or service terms are displayed, those additional terms also form part of the agreement.
If there is an inconsistency, more specific terms will generally apply to the relevant product, promotion or service, subject to applicable law.
33. Assignment
You may not transfer your rights or obligations under these Terms to another person without our prior consent where such consent is reasonably required.
We may transfer our rights or obligations as part of a genuine business sale, restructure, merger, acquisition or similar transaction, subject to applicable law.
34. Governing Law
These Terms are governed by the laws applicable in New South Wales, Australia.
You and Card Republic submit to the jurisdiction of the courts of New South Wales and courts entitled to hear appeals from those courts.
Nothing in this section limits any rights you may have under mandatory consumer protection laws that apply to you.

We may update these Terms from time to time to reflect changes to:
